Refers to Retailab's AI-powered product detection and auto-labeling platform, including but not limited to image processing, product identification, SKU matching, API services, and related software and documentation.
1.2. User
Refers to any individual or entity that accesses or uses the Service, including customers, API users, and visitors to our website.
1.3. Content
Refers to any data, images, SKU information, or other materials uploaded, submitted, or processed through the Service.
2.1. Account Creation
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
2.2. Account Security
You are responsible for maintaining the confidentiality of your account credentials, including passwords and API keys. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
2.3. API Keys
API keys are confidential and must be kept secure. You are responsible for all activities that occur under your API keys. Do not share your API keys publicly or commit them to version control systems.
3.1. Permitted Use
You may use the Service solely for lawful business purposes in accordance with these Terms. You agree not to:

- Infringe upon the rights of others

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.
4.1. Pricing Model
Our Service operates on a pay-as-you-go pricing model. Costs are calculated based on processed images and successfully detected products. Pricing details are available on our pricing page and may be updated from time to time.
4.2. Payment Terms
You agree to pay all fees associated with your use of the Service. All fees are non-refundable unless otherwise required by law. We reserve the right to change our pricing with reasonable notice.
4.3. Billing
You will be billed according to your usage. Payment is due according to the billing terms specified at the time of service purchase. Failure to pay may result in suspension or termination of your account.
5.1. Our Intellectual Property
The Service, including all software, algorithms, models, documentation, and related materials, is owned by Retailab and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our express written permission.
5.2. Your Content
You retain all ownership rights to Content you upload or submit. By using the Service, you grant us a limited, non-exclusive license to use, process, and store your Content solely for the purpose of providing the Service to you.
5.3. Feedback
Any feedback, suggestions, or ideas you provide regarding the Service may be used by us without obligation or compensation to you.
6.1. Privacy Policy

6.2. Data Security
We implement industry-standard security measures to protect your data. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

We retain your Content and data for as long as necessary to provide the Service and comply with legal obligations. You may request deletion of your data in accordance with our Privacy Policy.
7.1. Accuracy
While we strive for high accuracy in product detection, the Service uses AI and machine learning technologies that may not be 100% accurate. We do not guarantee perfect detection results and are not liable for errors or inaccuracies in detection.
7.2. Quality Threshold
Our Service only processes and charges for products detected with at least 80% confidence. Lower confidence detections are filtered out to maintain quality standards.
7.3. Service Limitations
The Service may have usage limits, rate limits, or other restrictions as specified in your plan or as communicated to you. We reserve the right to enforce these limits to ensure fair usage and system stability.
8.1. Termination by You
You may terminate your account at any time by contacting us or through your account settings. Upon termination, your access to the Service will cease, and you will remain responsible for any fees incurred prior to termination.
8.2. Termination by Us
We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for any other reason we deem necessary to protect the Service or other users.
8.3. Effect of Termination
Upon termination, your right to use the Service will immediately cease. We may delete your account and Content after a reasonable retention period, subject to legal requirements.
9.1. Service "As Is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
9.2. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RETAILAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
9.3. Maximum Liability
Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless Retailab, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property right; or (d) any Content you submit, post, or transmit through the Service.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.
12.1. Governing Law
